General terms of sale

Article 1. General principles

This document determines the general conditions of sale on the Online Campus offered by DIGITAL COLLEGE to the specified customer, designated by the contracts and agreements relating to the training programs.

Please read carefully all the information provided by the general conditions before agreeing to the contract. These conditions regulate the sale and are part of the offer.

The general conditions of sale hereby stated can be subject to unilateral modifications without notifying the customer. The applicable general conditions will correspond to those in force at the end of the contract accepted by DIGITAL COLLEGE.

The general conditions prevail over the applicable specific conditions; refer to the special conditions associated with each type of training as stated in the contracts and agreements defined in the chosen training offer.

Article 2. Introduction

The Online Campus is designed and marketed under the name of DIGITAL COLLEGE, SARL, with a capital of €30,000.00, whose registered office is located at 15 Rue Montmartre 75001 Paris, registered with the Paris RCS under number 797 546 660.

The Digital Campus offers degrees or qualifying remote training, in a classical training-course or under an apprenticeship contract.

Article 3.  Prerequisites for the execution of the contract

The customer is capable and declares to be able to agree to the said contract.

The customer acknowledges having given his informed consent and accepted the given offer.

By its nature, this offer is strictly personal and cannot be transferred. The contract(s) may not be assigned, encumbered, transferred, or otherwise convey binding rights and obligations between the identified parties.

Article 4. Purpose of the contract

Any improvement made, in the interest and the quality of our teaching, cannot be opposed to us: any modification of the programs, the selection of the speakers, the organization of the courses and the schedules are exclusively chosen by DIGITAL COLLEGE.

The customer’s consent is active from the validation of the order, with an obligation of payment and the acceptance of the final offer once confirmed after verification of the customer. Cash payment is required upon registration.

The price of our offer is expressed in euros, DIGITAL COLLEGE grants itself the right to unilaterally modify the pricing of the said offer at any time.

Note that errors may occur, despite all the means implemented to ensure the client of the accuracy of the proposal.

In the event of an error or overload beyond our control, we will inform the customer as soon as possible using the contact details that the latter will have sent us.

Article 5. Application and registration

The training, accessible from the first year of tertiary education, can be pursued over 6 years, from the Bachelor to the MBA, as a classical training-course or under an apprenticeship, so as to enforce the project-based training education praised by the school on a daily basis. Each cycle leads to obtaining the title approved by the State, registered at the Registre National des Certifications Professionnelles, levels I and II.

In accordance with the applicable legislation, the client, candidate, registers for training, the benefit of which he can justify.

The conditions for filing an application are listed according to the chosen training program.

The admissibility of the application is the sole decision of  DIGITAL COLLEGE. DIGITAL COLLEGE is authorized to refuse any registration application without the need to communicate the reasons for its refusal.

As part of each training, the client will be subject to the rules and procedures specific to the selected training. The client undertakes to respect the conditions of the acts and agreements signed with DIGITAL COLLEGE.

5.1.1 Costs included in the service: Application fees, registration fees and access to the online training and exam interface of the Online Campus.

5.1.2. Excluded costs payable by the customer: Costs independent of the interface.

5.1.3 Conclusion of the contract: The general and specific conditions are applicable upon acceptance of the contract and payment of the costs relating to the digital training(s) selected by DIGITAL COLLEGE. The price of the offer expressed and granted by DIGITAL COLLEGE is in no way negotiable or opposable to DIGITAL COLLEGE.

All paper fees. All requests to send paper support will be invoiced to the customer in accordance with the conditions of receipt of his residence. Any additional eligibility or accommodation studies requested from DIGITAL COLLEGE.

5.2. Payment: The fees due are to be paid as soon as the order is placed with an obligation to pay by credit card or through an e- wallet proposed by the interface. The other means of payment made available are communicated and accepted according to the discretionary opinion of the headquarters, to be discussed directly with the DIGITAL COLLEGE administration.

5.3. In the event of a payment incident: We will require a regularization from the customer and the latter undertakes to pay us the amount due to our services.

In the event of a payment incident, DIGITAL COLLEGE grants itself the right, at any time, to consider the contract null and void.

We may refuse to offer a new conclusion of the contract.

Article 6. Evaluations

DIGITAL COLLEGE evaluates the results of the client as required in the different formats offered by the interface. Any dispute by the client against the decision of the awarding jury is only admissible if it is clearly motivated and proven by the client within a maximum period of 3 days after the publication of the results. DIGITAL COLLEGE will make its final decision without details.

Article 7. Withdrawal, cancellation and termination

The customer has a period of 14 days to withdraw. If he wishes to exercise this right within the time limit, the client is required to send this request by registered letter with acknowledgment of receipt to DIGITAL COLLEGE.

In the event of total or partial cancellation or termination of the training order, a pro rata temporis refund of the sums paid will be made according to the requests submitted to DIGITAL COLLEGE, the access granted and the content used or made available to the customer.

He will still be charged for the access to the interface, the content and the training that would have been consumed during this period. The pro rata is calculated according to the criteria defined by DIGITAL COLLEGE, he could also be responsible for withdrawal or cancellation fees reaching the totality of the sale initially granted. In cases of abuse, an additional penalty will be required.

Article 8. Exceptional situations

We cannot be held liable in the event of the non-performance of our obligations if it is attributable to an external event or prejudice.

In the event of force majeure, any non-performance or delay in performance such as those defined by the Code Civil and by case law is not our responsibility. Force majeure means any external, unforeseeable and irresistible event, as such we cannot be held responsible.

DIGITAL COLLEGE does not respond to exceptional circumstances and cannot be held responsible, towards the client or any other third party, for any incident relating to exceptional circumstances arising ex ante and ex post.

Article 9. Intellectual Property

Under Article L 111-1 of the Intellectual Property Code, relating to intellectual property, the author of the Digital Campus relating to intellectual property, the author of the Diploma application site enjoys an exclusive intangible property right that is enforceable against all. This right includes attributes of an intellectual and moral nature as well as attributes of a patrimonial nature.

In accordance with the legal bases applicable in this matter, the interface of the Online Campus is an intellectual creation specific to its author, due solely to its creation and design. The exploitation of the program’s functionalities is only authorized to contractors who have received an agreement from the author.

The footprint of the Online Campus, the source programs are similarly protected by the intellectual property code, as well as the source codes, insofar as they are the materialization of the intellectual effort of the author.

The author retains all rights to the content presented by the Online Campus.

Any use contrary to the purpose of the training contract, being by its nature nominative and exclusive to the contractor, is liable to legal action.

Article 10. Confidentiality and Protection of personal data

On the one hand, customers undertake to maintain the confidentiality of all data from the Online  Campus, whatever their nature.

On the other hand, information or personal data communicated and transmitted by the customer will be processed under the general data protection regulations. By signing these conditions, the customer agrees to the processing of this information and contact details and declares that all information or contact details provided are true and accurate.

In accordance with the regulations in force, the data are kept for a limited period of time corresponding to the purposes for which they were collected, and in compliance with legal, contractual, tax, social obligations and for the defense of our legitimate interests.

Article 11. Applicable legislation and competent jurisdiction

The parties are subject to French law.

In the event of a dispute relating to these general conditions of sale of the Online Campus,  the competent court will be the one attached to our registered office.
